Massachusetts Divorce Mediator
Divorce mediation in Massachusetts is a voluntary, confidential process in which a neutral mediator helps spouses work collaboratively to resolve key issues such as asset division, parenting plans, child support, and alimony without going to court. Mediation in MA is designed to reduce conflict and cost by fostering open communication and allowing couples to maintain control over the outcome rather than leaving decisions to a judge.
The process typically involves signing an agreement to mediate, gathering financial and parenting information, and working through several structured sessions to negotiate terms that must be based on full financial disclosure, as required by Massachusetts law. Successful mediation is less about compromise vs. ensuring each party’s underlying interests are met.
Mediators guide discussions but do not make decisions or provide legal advice, and the Massachusetts Uniform Mediation Act ensures confidentiality throughout the process. Once agreements are reached, the mediator assists in drafting a tentative settlement for court review but in MA, it is required that an attorney review and finalize the settlement.
